ICO consultation on generative AI and data protection

Businesses are invited to share their views to help inform ICO's regulatory position on generative AI

The Information Commissioner's Office (ICO) is running a consultation series on how aspects of data protection law should apply to the development of generative artificial intelligence (AI) models.

Their first call for views focused on the lawful basis for scraping data from the web or processing web-scraped data to train generative AI models.

Their second call for evidence is now underway, covering the purpose limitation principle and how it should be applied at different stages in the generative AI lifecycle.

Stakeholders with an interest in generative AI are invited to respond to this call. This includes developers and users of generative AI, legal advisors and consultants working in this area, civil society groups and other public bodies with an interest in generative AI.

The deadline for responses to the second call for evidence is Friday 12 April 2024.

You can respond to this call for evidence using the survey, or by emailing the ICO at generative.ai@ico.org.uk.

Your responses will help the ICO develop their final regulatory positions on generative AI which will be reflected in ICO's updates to guides on AI and other products.

A third call for evidence will follow later in the year, focusing on how the accuracy principle applies to the outputs of generative AI models, and the impact that accurate training data has on the output.
